La justicia del Reino de los Pa\u00edses Bajos puso una pausa a las pretensiones de una transnacional estadounidense para resarcir los da\u00f1os ocasionados por la expropiaci\u00f3n de sus bienes en Venezuela, mediante el\u00a0embargo de activos de Petr\u00f3leos de Venezuela (Pdvsa), que podr\u00edan incluir instalaciones de la estatal venezolana en Bonaire<\/strong>.<\/p>\n

As\u00ed se desprende de la sentencia de un tribunal colegiado de La Haya, que conoce la reclamaci\u00f3n por da\u00f1os y perjuicios formulada por\u00a0Owens Illinois<\/strong>\u00a0contra la estatal petrolera venezolana y sus filiales Bariven, Propernyn BV, Pdvsa Services BV y Pdv Europe BV.<\/p>\n

Propernyn BV, a su vez, es la firma propietaria de las acciones de capital de la\u00a0Bonaire Petroleum Corporation (Bopec), cuya sede en la antilla sirve como\u00a0almac\u00e9n y punto de reexportaci\u00f3n del crudo venezolano<\/strong>, gracias a que posee un puerto de aguas profundas.<\/p>\n

Sobre Bopec hay varios litigios en marcha, en virtud de la incapacidad del gobierno venezolano para cumplir con los pagos por el arrendamiento de sus instalaciones, seg\u00fan un acuerdo que estuvo vigente desde 2002.<\/p>\n

\u00a1Expr\u00f3piese!<\/strong><\/h3>\n

El juicio de La Haya fue entablado por la corporaci\u00f3n estadounidense con sede en Perrysburg, Ohio. Seg\u00fan el expediente, se trata del mayor productor mundial de envases de vidrio, y figura en\u00a0la lista Fortune<\/strong>\u00a0500 de empresas con mayor capital de EEUU.<\/p>\n

En Venezuela, la transnacional era propietaria de una subsidiaria con el mismo nombre, e igualmente de la\u00a0F\u00e1brica de Vidrios Los Andes CA<\/strong>. En octubre de 2010, las dos factor\u00edas fueron expropiadas por mandato del entonces presidente\u00a0Hugo Ch\u00e1vez<\/strong>. Su argumento: \u201cTiene a\u00f1os explotando a los trabajadores, destrozando el ambiente y llev\u00e1ndose el dinero de los venezolanos\u201d.<\/p>\n

Owens Illinois inici\u00f3 un procedimiento de arbitraje contra Venezuela en el\u00a0Centro Internacional de Arreglo de Diferencias Relativas a Inversiones<\/strong>\u00a0(Ciadi). El 10 de marzo de 2015, esa instancia decidi\u00f3 que el pa\u00eds suramericano deb\u00eda pagar\u00a0372,4 millones de d\u00f3lares<\/strong>\u00a0por da\u00f1os y perjuicios, as\u00ed como\u00a05,75 millones de d\u00f3lares<\/strong>\u00a0en costas procesales, m\u00e1s intereses por mora.<\/p>\n

Venezuela solicit\u00f3 posteriormente la anulaci\u00f3n del referido laudo. Pero en diciembre de 2018, esta petici\u00f3n fue rechazada. Para ese momento, el pa\u00eds adeudaba\u00a0m\u00e1s de medio millardo de d\u00f3lares<\/strong>, en virtud de la acumulaci\u00f3n de intereses por mora.<\/p>\n

\u00bfPdvsa no es Venezuela?<\/strong><\/h3>\n

La decisi\u00f3n del juzgado neerland\u00e9s reconoce que Owens tiene derecho a resarcir los da\u00f1os ocasionados por la expropiaci\u00f3n ordenada por Ch\u00e1vez. El punto es que durante el contradictorio\u00a0no se logr\u00f3 una plena identificaci\u00f3n entre el Estado venezolano y Petr\u00f3leos de Venezuela<\/strong>.<\/p>\n

En juicios ventilados en EEUU, en vista de reclamaciones por da\u00f1os ocasionados por actos terroristas, la estatal petrolera es vista como una extensi\u00f3n de los intereses del gobierno. Seg\u00fan este principio, han dado luz verde a solicitudes de embargo formuladas por v\u00edctimas de las\u00a0Fuerzas Armadas Revolucionarias de Colombia (FARC)<\/strong>.<\/p>\n

En el \u00e1mbito netamente mercantil, la justicia de EEUU tambi\u00e9n aval\u00f3 el reclamo de\u00a0Crystallex<\/strong>\u00a0por la expropiaci\u00f3n de sus activos en Venezuela, y autoriz\u00f3 el embargo de bienes de Pdvsa en territorio norteamericano.<\/p>\n

Pero en los tribunales neerlandeses rigen otras leyes. Este punto fue subrayado en la decisi\u00f3n colegiada.<\/p>\n

\u201cEl tribunal encuentra en la literatura y jurisprudencia evidencia insuficiente de que aplicando los criterios fijados por (Owens Illinois) se puede concluir que\u00a0Venezuela debe identificarse con Propernyn, PDVSA Servicios y PDV en el sentido de que (Owens Illinois) puede recuperar su reclamo contra Venezuela<\/strong>\u00a0de Propernyn, PDVSA Servicios y PDV\u201d, indica la decisi\u00f3n.<\/p>\n

M\u00e1s adelante, el texto se\u00f1ala una falla en la probatoria de los abogados de la transnacional estadounidense: \u201cNo se ha argumentado ni demostrado que Pdvsa y otros estuvieran involucrados en la expropiaci\u00f3n de las f\u00e1bricas de las subsidiarias de OIEG por parte de Venezuela\u201d.<\/p>\n

El reclamo de Owens fue rechazado en cuanto a la forma que puede aplicar para recuperar lo estimado en el laudo arbitral. Pero\u00a0esto no pone punto final al prop\u00f3sito de la transnacional estadounidense<\/strong>\u00a0para recuperar las p\u00e9rdidas por la expropiaci\u00f3n de sus activos en Venezuela.<\/p>\n

Justice of the Netherlands stops the embargo of Venezuelan assets in Bonaire<\/strong><\/h3>\n

The justice of the Kingdom of the Netherlands put a pause on the claims of a US transnational company to compensate for the damage caused by the expropriation of its assets in Venezuela, through the seizure of assets of Petr\u00f3leos de Venezuela (PDVSA), which could include installations of the Venezuelan state in Bonaire.<\/p>\n

This follows from the ruling of a collegiate court in The Hague, which hears the claim for damages filed by Owens Illinois against the Venezuelan state oil company and its subsidiaries Bariven, Propernyn BV, Pdvsa Services BV and Pdv Europe BV.<\/p>\n

Propernyn BV, in turn, is the firm that owns the capital shares of the Bonaire Petroleum Corporation (Bopec), whose headquarters in the Antilles serve as a warehouse and re-export point for Venezuelan crude, thanks to the fact that it has a deep-water port. .<\/p>\n

Regarding Bopec, there are several lawsuits underway, due to the inability of the Venezuelan government to comply with the payments for the lease of its facilities, according to an agreement that has been in force since 2002.<\/p>\n

The Hague lawsuit was brought by the US corporation headquartered in Perrysburg, Ohio. According to the file, it is the world’s largest producer of glass containers, and appears on the Fortune 500 list of companies with the largest US capital.<\/p>\n

In Venezuela, the transnational owned a subsidiary with the same name, and also the Los Andes CA Glass Factory. In October 2010, the two factories were expropriated by order of then President Hugo Ch\u00e1vez. His argument: \u00abHe has been exploiting workers for years, destroying the environment and taking money from Venezuelans.\u00bb<\/p>\n

Owens Illinois initiated an arbitration proceeding against Venezuela at the International Center for Settlement of Investment Disputes (ICSID). On March 10, 2015, that instance decided that the South American country should pay 372.4 million dollars in damages, as well as 5.75 million dollars in procedural costs, plus interest for late payment.<\/p>\n

Venezuela later requested the annulment of said award. But in December 2018, this request was rejected. At that time, the country owed more than half a billion dollars, due to the accumulation of interest for late payment.<\/p>\n

PDVSA is not Venezuela?<\/h3>\n

The decision of the Dutch court recognizes that Owens has the right to compensate the damages caused by the expropriation ordered by Ch\u00e1vez. The point is that during the conflict, a full identification between the Venezuelan State and Petr\u00f3leos de Venezuela was not achieved.<\/p>\n

In lawsuits aired in the US, in view of claims for damages caused by terrorist acts, the state oil company is seen as an extension of government interests. According to this principle, they have given the green light to embargo requests made by victims of the Revolutionary Armed Forces of Colombia (FARC).<\/p>\n

In the purely commercial sphere, the US justice system also endorsed Crystallex’s claim for the expropriation of its assets in Venezuela, and authorized the seizure of PDVSA assets in US territory.<\/p>\n

But in the Dutch courts other laws apply. This point was underlined in the collegiate decision.<\/p>\n

\u201cThe court finds in the literature and jurisprudence insufficient evidence that applying the criteria set by (Owens Illinois) it can be concluded that Venezuela must be identified with Propernyn, PDVSA Servicios and PDV in the sense that (Owens Illinois) can recover its claim against Venezuela of Propernyn, PDVSA Servicios and PDV\u201d, indicates the decision.<\/p>\n

Later, the text points out a flaw in the evidence of the lawyers of the US transnational: \u00abIt has not been argued or demonstrated that PDVSA and others were involved in the expropriation of the factories of the OIEG subsidiaries by Venezuela.\u00bb<\/p>\n

Owens’ claim was rejected as to the way he can apply to recover the amount estimated in the arbitration award. But this does not put an end to the purpose of the US transnational to recover losses from the expropriation of its assets in Venezuela.<\/p>\n
